Eli couldn't complete the firecape because of this, now he's offering you the cape for free and you're saying you don't want to take the risk? Why did you order the cape in the first place then? But sure, if you don't want a free cape that's not my problem. Feedback removed and dispute closed. You will have to give TLS_ELI his stuff back though, and TLS_ELI will have to refund the payment if that happened.

At this point is practically impossible to determine who did what on the account. @vojtaS could've done it to try and screw devry or his workers over @koboldNinja could've done it when he was doing the quest @skill a pure could've dropped it after getting it for whatever reason. Considering we have no idea what has happened, and it's practically impossible for us to determine, I will leave it up to Devry and voitaS to come to an agreement.
