what i've noticed osbot is fast on picking up off-site scammers, but it might be hard to keep track of all of em

We only ever allow them back when they refunded in full and can provide proof. In some circumstances, we allow them back under TWC. It's depending on the case really. 

How do you know they aren't coming back to try and scam 5x what they refunded to get back on?

They dont, but as he said, depending on the case they sometimes/most of the tim put them in TWC

but what would we do 

If those people have sufficient evidence to prove that they either didn't scam, refunded, or it was something that happened ages ago and we feel like they did change then it's possible that we allow them to return to this community, possibly with TWC. You just don't know the whole story in some cases. But obviously we don't go around checking every community for people that scammed there and banning them on OSBot so feel free to report it if you find them and they haven't been reported before. And trust me, we were aware of the @Gellie case, she was banned before and we spent quite a while discussing her case and requesting evidence before we decided to unban her.
