sometimes people act out of spite quickly without realizing what they have done. Giving them a second chance is important.

Doesn't always guarantee an unban and doesn't guarantee you're not gonna be forever-TWC.

sounds better, coz on all disputes i have seen a mod say "if he wishes to return he has to refund" which kind of means that he can come back any time.

not at all, you lose all rep, people wont trust you with big trades, etc. there are so many negatives

imo TWC should never be removed, unless it happened years ago. 

the other option would be that the scammer just makes a new account

They are TWC'ed until staff thinks its safe for them to be removed from TWC, some of them even end up in lifetime TWC.

You have to keep in mind that if you don't incentivize refunding that no one would ever do it.

 

It's still shitty but in the end the community loses less because of it.
