Dispute against Marwan44

Explanation: Basically with the Consent of @niyajuan I got @Marwan44 to Finish of an Order that I had started. The Original Order was agreed on the price of 18M 07 GOLD. Again with @niyajuan's Consent I hired @Marwan44 to complete The Grand Tree [1-20 Agility], Death Plateau and Dwarf Cannon for the Agreed Price of 3.5M that HAS BEEN PAID Already by me from the Original 18M (Proof - http://prntscr.com/ljp0u0

After Payment, I immediately went to @niyajuan to confirm that the Service has been Completed. Three Minutes later he comes up to me and says that through my Service his Registered E-mail Had been changed to a disposable e-mail provided by sharklasers.com (Proof in Evidence Section).

At this Point I contacted @Marwan44 and informed him with the Situation to which he replied that he had done no such thing. Based on the General Osbot Terms of Service, till this point there was really no proof that either myself or the mentioned Freelancer could have changed the E-mail, and it would be @niyajuan's responsibility to ensure that the account he is getting Service on is Safe and if not he understands the risks prior to having it Serviced.

 

However I felt that something was not right, and in my sight it was either @Marwan44 or @niyajuan lying, so I grabbed hold of @niyuwan via Discord and got him to explain to me what exactly happened, and how his account with an E-mail Login ending with @yahoo.com did not have that e-mail registered to it.

Basically for those who do not know, when you make an account with a LEGIT e-mail (Such as G-mail, Hotmail, Outlook, yahoo, etc.) Jagex will try to Register that E-mail to your Account. An E-mail Link will be sent to your Creation E-mail and if it is CONFIRMED it will be your Registered E-mail. HOWEVER in this case it is most likely the fact that @niyajuan did not confirm the Registration E-mail (He's shown me his Yahoo Account inbox and there was no such Confirmation E-mail).

YET at this point there was no solid proof that infact @Marwan44 had been the one whom registered that e-mail to this Customer's account so at this point I offered @niyajuan either (a) 30M Refund based on the fact that he had paid me 18M for Quests mentioned above + the Stats the Account had prior to Service and a Bond's Value http://prntscr.com/ljp464 OR (b) A Full FREE Remake of the Account on a Fresh Tutorial Island Account of his Creation (With a GUARANTEED Registered E-mail from him).

@Niyajuan accepted this offer however he also confirmed to me that he was the Original Owner and Creator of the Account. Stating this, he has went ahead and made a "Do not have access to Registered E-mail" Recovery attempt to which I have not yet been informed of the Outcome. However knowing that he has Access and Creation of the Yahoo account used as a Login Name to the Account, Provided that as the E-mail to which Jagex will be sending a reply, and has also provided in his appeal all Creation Details, he is most likely to be Granted Recovery and will be able to re-register his own e-mail.

 

I kept on digging and after being finished or better say, done all that I could with the Customer, I moved on to the Freelancer @Marwan44 and did some digging around on his end.

I tried to sweet talk him on discord about the Situation, the fact that in the case he did register an e-mail as a troll joke or something, I promised that I'd be able to help consolidate the Customer into understanding it was a joke or something. He Denied the this statement however he did mention that he was unable to complete "The Grand Tree Quest" and apparently decided WITHOUT MY Permission furthermore @Niyajuan's (The Customer's) Permission hired somebody from Sythe to do the quest for him.

Apparently the Guy who'm he has hired from Sythe is XeroBone (https://www.sythe.org/members/1090799) - Might not be the Correct Guy but based on the Copy and Paste Marwann44 has sent me on discord showing himself asking this guy XeroBone if he put a registered e-mail on the account, I guess that was my only lead on that. http://prntscr.com/ljpade

As far as I'm aware it's against Terms of Service that the User @Marwan44 out of his will went ahead and hired without my Consent (As I was responsible for the Work being done for Nyajuan).

So that's already enough said to how my customer could have gotten a troll e-mail registered to his account.

I would also like to mention that once I mentioned me opening a dispute about this to the Freelancer (Marwann44) he immediately started hiding behing sythe's Rules, and the fact that he does not care if this gets him banned on osbot. To me that's just playing the "I don't care guy, ban me if you want, but I don't give a fuck" Type of Situation, so more than the whole explanation this could also lead to the understanding that this User together with the Sythe person got my customer's account registered to a troll e-mail.

 

To Conclude I have offered my Customer that regardless of the Outcome of his Appeal (Obviously unless it's a successful one) or should the User in Dispute be found guilty and asked to refund the damages and does not, I offered that I'd do the quests he paid 18M for FREE on his new account. 18M is nothing compared to me having this Customer reassured that here at osbot we offer quality Service and it's not just about making money but strengthening our community.

Update 

My Customer has been able to successfully recover the account and register his personal e-mail on it.

Thus both of us can confirm that the account is SAFE http://prntscr.com/ljt7b9 and http://prntscr.com/ljt7fv

 

However both of us would still like Staff to take action on @Marwan44 in the light of protecting fellow community members from having to deal with the same situation.

I believe that the user has mentioned to me that he is, as we speak, working for other community members, and I strongly believe that having read and proved what he's done with this customer, he should not be let off at ease after this situation.

The situation has been discussed with @Maldesto and @Decode and we have come to the following conclusions:

  • @Marwan44 will remain permanently in TWC for sketchy actions
  • @BestCaper must refund @niyajuan the full cost of the order, regardless of if the account has been recovered or not
  • @BestCaper's service thread has been unlocked; from now on ALL workers must be listed on this thread and you will be held more liable for their actions therefore.

Please let us know when the service has been refunded so we can close this.
