Explanation/Evidence:

First off let me preface this by saying I did not want to have to create this dispute. I went through every possible method to resolve this, and my experiences with Xylate have previously been very good. I do not know why this experience was so dramatically different but today I saw a different Xylate, and I hope the old one returns soon. 

1. Was interested in buying everything in thread above, so I messaged Xylate on May 14th, 2017.

3. We hadn't discussed the price at all yet, and Xylate says this
   
   From what I can tell it sounds like he wanted to cut me a deal and lower the price. Since he was randomly sending me this list based solely on price, I assume the contents in #2 above were included, as they were not to be effected by price.

   Xylate will argue that this was a completely different purchase than what was in the thread. I do not know if this was his secret plan all along or not.
   
   Regardless, Xylate has so far only sent the server, I have not received the scripts in #2 or the examples scripts in the list above. 
   
   Regardless, there was never any chats that what I was buying was different than what was in the thread AND right after I purchased it, he updated the thread with "Sold". Now, unless he sold it to someone else, this is evidence that what I purchased was a version of what was in the thread and should include the items in #2 above.
   
   
    
4. Xylate had agreed to help me set up the system and a few days after he sent me the source for the server he helped me set up and get it running. I was under the impression we would be setting it up from start to finish and I would be botting with the scripts shortly. We got the server source set up with MySQL and an expensive server I purchased, and I never received the scripts. I was confused the whole time because I thought he would be setting up the scripts, but he never did. I figured it would be okay because I was getting my own scripts made meanwhile and didn't say anything because I didn't want to start anything (that could lead to creating a dispute...).
5. Getting my own scripts made proved to be difficult, and Xylate seemed to think the transaction was complete. I didn't want to bug him too much, but On May 25th I very politely asked Xylate to include the stuff in #2 above.
6. Xylate denied, saying I didn't buy what was in the thread and said he would be throwing in these example script classes as a replacement which was completely new to me. Keep in mind, he never sent me the example script classes either.
   
7. Throughout the next few days I continued to ask about the script, to no avail. Clearly Xylate didn't want to honor his word but I really didn't want to cause drama or create a dispute.
8. I tried to resolve the issue in many ways, including a chat with @Decode to try and mediate and resolve the situation. I offered to pay $50 extra to receive the scripts and resolve it before it escalated to a dispute because Xylate said he would be lowering the price to $1350 the day before I bought it and I paid $1300.

I am open to the following resolutions: 

• Receive the scripts
• Xylate makes comparable script of my chosing (including tut island, 7qp, muling, tasks)
• A full refund on the total amount spent

No where in this does it say I was giving you all of those scripts you wanted. The thread that I posted on osbot was priced at $1,500 and the feature list was completely different from what is above.

 

I don't think I should have to post anything else. Just saying.

Why would you put "sold" in your thread, if you didn't sell it to Jordan? I am confused on why you think he would pay $1300, but not get what he wanted? This picture right here shows me he was under the impression he was getting this when price was agreed upon

Because I was only selling it to one person, no matter what the features were. That is why it was marked as closed.

 

He has the rights to what was posted in this that was sent over skype. NOT what I posted on the forums for $1,500. He's wanting a fucking refund for 'free' shit that doesn't even have to do with what I was selling.

@Jordan what exactly are you missing from your "order" that you were under the impression you were getting. I can't really force him to pay for your "assumptions" when it isn't in the list of items he provided.

I wasn't assuming, it's what Xylate said in his for sale thread.

Of course I would want to integrate my own scripts, but I would also like the script I paid for as well. I don't want to just Oak farm, and Xylate knows this, I don't know why he would think me wanting to integrate my own scripts is some smoking gun. 

When Xylate sent the list of what I was purchasing, he changed a few things from the thread, and that is completely fair game. What is not fair game is the stuff he himself said in the thread would not be effected by price, everything else is and was.

 

Xylate's argument is essentially "I lowered the price and it was not included in the lower price" which blatantly contradicts "it has no effect on my price, at all". Xylate is essentially arguing with himself at my expense. I paid $1,300 for this out of company money and didn't get everything. I have a partner. You know I can't just spend $1,300 of money that isn't mine and then not dispute this. I owe it to my company and I owe it to my partner.

I don't understand why it's a problem. Xylate told me yesterday he doesn't use the farm anymore and he won't be using the scripts. I offered to pay the difference between the two and Xylate still declined. Xylate said in his thread it is useless to him so I don't know why he's forcing me to dispute this. I thought this would be an easy resolution in 30 seconds days ago. Something is fishy, he is going back on his word and using some imaginary loophole technicality he tried to create for himself at my expense. 

I was 100% clear on what I was purchasing when it came to the scripts I had no reason to ask for them to be included at any point because they were included regardless of the price I paid, and he does not wish to honor that.

 

 

Here he says he wouldn't even re-integrate the scripts for me even though he said he would walk me through integrating my own scripts when I get them. It would be the exact same thing, and he agreed to do that as well. So either way here, he's scamming.

Also, Xylate offered support walking me through everything and integrating my own scripts. I do not believe I will be receiving that support based on the chat logs and his obsession with not honoring his own word even after he himself said it was useless to him.

As far as support, I setup everything for you already on your PC. As far as integrating your own scripts, you've never asked me for this help yet :).

Why are you being so difficult? This should be a 30 second resolution, Xylate. You keep ignoring your own words. Please explain why the two things below have changed and why it's my fault for them changing?

You were the one who closed it and said sold + i'm quoting because it proves I bought what was in the thread. Also, you're talking about price, which has no effect on the script in question.

Your thread said "Starting bid: 1500" not "1500 firm".

He can't say he didn't sell me what was in the thread when he did. He never once said it was different, and, it wasn't. 

Is he really trying to say because we talked on skype about it that it erases the existence of that entire thread and everything that was in it? That's not how trades work. Theres a thread -> you discuss it on skype. It never deletes the existence of a thread unless specified, and it was not specified, ever, period.

We modified things based on price, the script in question was not to be effected by price.

He contacted you about your thread @Xylate Because he paid 1300, not 1500 has no holding with me. You guys negotiated on the 1500, and came up with 1300. Give him  what was said in the thread.  If i contact someone over the phone about a car, and tell them I want the car, and they want 5,000 for it, and I get there and talk them to 4,500, can they just swap the car out with a different car? NO. Give Jordan what he paid for, or he can open a dispute on Paypal, then you can open source whatever you want. Either way, I don't see the point in acting like he didn't want this extra stuff you said had no effect on the price. I'm not sure why you would think that he just doesn't want it, if its free of charge? He offered to pay the difference, and you refused that. Clearly you are being stubborn now, just because you are upset. Take a bit and think about the situation, is this really all worth it? You already have all this done, and easy for you, over a few dollars are you going to lose all your reputation? I don't understand where it went wrong, but it did. Just give Jordan the few things he was expecting from your thread, or refund the money, or he can open a dispute.  Jordan will not use anything you gave him without your permission if you refund the money, and if he does, he will be IP banned from OSBot.

There was nothing negotiated, ever.

 

He was given a different feature list on skype that was COMPLETELY different.

 

 

A refund, scripts, anything as such is out of the question.

 

Mald, I'm not sure if you're getting stuff twisted around or not, but feel free to contact me. I'd like you to personally see skype logs instead of this shit.
