Can you get torso without 40 def? Like just have it in your bank but not use it?

Upon buying, one of the requirements say 40defence. (Look at the screen shot above).

 

I haven't tried buying a Torso without 40defence, since all the accounts I've done torso for is either 40def or higher :)

I've never done barb assault so, you could technically sit there with enough points to get a torso, wait till 40 def, then buy one instantly right?
