Dispute against MyWayHosting

Thread: http://osbot.org/forum/topic/40555-mwh-proxies-web-hosting-domains-vps/

Explanation: Not even 24 hours ago, I purchased a VPS off of MyWayHosting. The only reason I was even able to do that was because I had first had to purchase a $3 proxy off the user Jeff who had purchased 5 from MWH so he could make room for a VPS that I could then buy. After doing that I made the purchase through his website for his Level 5 package. He created the desktop and gave me the IP so I could connect through VNC. So the VPS was all set up. Since I was planning on botting multiple accounts, I needed proxies. I had asked before if MWH could sell me proxies but said that he didn't have any in stock and wasn't planning on buying any soon. So I obviously had to purchase from somewhere else. I purchased 5 proxies from another site and was waiting for them to come in so MWH could help me set them up but he had to get off for bed because he had work in 6 hours and my proxies weren't in anyway. So today I waited all day for him to get on and when he did I asked him to help set the proxies up or at least tell me what to do. At first, he even said that he'd do it himself.

I asked if he was ready to help and he said in a few, I waited like 20 min or so and asked again and then he goes on telling me that since they are not his proxies he doesn't support it. Then literally for the next half hour is just me asking if he can please just tell me the steps on what to do or anything he can do to help and it's just a constant "I'm busy with other people. I don't support other proxies. I can't help you."

It finally gets to the point where I didn't want to be bothered with this anymore and I asked him for a refund.

I checked his TOS on his webiste and no where does it mention anything about NOT getting refunds.

Not sure if this means anything but this is what happens when you click on the Privacy Policy and DMCA Policy.

I had my friend also check these links to make sure it wasn't just me and had him look over his site to see if he could find anything about a refund policy.

I do not want his VPS anymore. I have not even had it for 24 hours so I have in no way taken advantage of it and now just want to get my money back. MWH just acts like a dick and I in no way want to be affiliated with him. I payed $45 for his Level 5 packge and I do NOT want it anymore. I really never wanted to have to ever post anything in the dispute section but I am no way going to let $45 slip away on something I no longer want at all.

You purchased the VPS, he set it up completely for you in return.

I don't see why you're filing a scam report on him because he won't help you set up proxies that weren't sold by him? The user has the right to deny a refund due to nothing being wrong with the product he provided.

If something were to happen to your VPS, data loss, hours of downtime, you would then be credited by how long the issue has been going on for. Under these circumstances, we cannot give you a refund. I did tell you that you could wait on a written guide so you can do it yourself.

This isn't a scam dispute. The point of the matter is that I have not had the VPS for even 24Hours. Originally, he was going to make me pay I think an $11 extra just to get the VPS up and running because he didn't want to purchase the extra IPs needed himself. So he had me contact the user Jeff and buy a proxy off him just to even be able to purchase the VPS. And no where in his TOS does it say that I am not allowed a refund.

I'm confused by this.

You've said it yourself that this isn't a scam dispute, but that is what this section is for. I'm sorry but there is nothing we can do for you in this case.
