This trade was an illegal trade of property that belonged to neither of us, and as a trade that is against Jagex terms of service, he is well aware of the risk he takes when making a trade of this nature.

 

I am not at fault here. I traded him the account, Jagex noticed that the account had been traded - which is illegal, and they took action. Gorilla is just as at fault as I am because I am the drug dealer, and he is the drug user.

 

I argue that because he knew that the trade was against Jagex terms of service, and that he knew that the account may be locked as a result of this trade, then I do not owe him a refund.

 

The case would have been different if I had tried to recover the account, but I did not, and he can not prove that I tried to.

I have no part of this and I know i should be pming him about this but If you send Jag@jagex.com and try to recover it via email it will tell you if the owner recovered or not that shall help you with more proof.

You must assist him in receiving the account back. Jagex will likely be contacting you since it is your account. Either you recover the account / assist him in doing so, and then give it to him, or you refund him.

Going back to the analogy, OSBot is the drug dealer. You're a supplier of us. We suspect you to make sure the drugs arrive safely to our customers.

 

 

When I sold him the account I changed all of the info to his - so Jagex can not contact me. I also did give him all the info I got in order to recover the account (It was not my account originally).

 

And expanding on your take for the analogy. I did deliver the drugs safely - he just got caught with them.

Where did I agree to a TOS stating that if he gets his account locked I am responsible. How do you know that he did not re-sell it and then it got locked?
